1.1 www.optionsmembers.co.uk is a site (the “Website”) operated by Options UK (“Options UK” and “We”). We are registered in England and Wales under company number OC345142 and have our registered office 1st Floor, Lakeside House, Shirwell Crescent, Furzton Lake, Milton Keynes, MK4 1GA. We are a limited company.

1.2 Your access to and use of the Website is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website. We recommend that you print a copy of these terms for future reference.

3.1 temporarily or permanently change, remove, suspend, withdraw or restrict the availability of  the Website or any part of it without notice and you confirm that Options UK shall not be liable to you for any such change or removal; and

3.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change. Every time you wish to use the Website, please check these Terms and Conditions to ensure you understand the terms at that time.

  1. ACCOUNT DETAILS

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of Options UK security procedures, you must treat such information as confidential. You must not disclose it to any third party.

Options UK have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms and Conditions.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify Options UK at workplacepensions@optionspensions.co.uk

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is provided for your information only and is not an endorsement by Options UK of such websites or information you may obtain from them. You acknowledge and agree that we are not responsible for and have no control over the content or availability of any such sites.

6.1 All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Options UK or otherwise used by Options UK as permitted by law. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

7.4 If you are a consumer user:

  • Please note that we only provide the Website for domestic and private use. You agree not to use the Website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  • If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. [However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.]

7.5 Options UK makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.  

7.6 Options UK has taken all reasonable steps to ensure that the information contained within the pages of the Website is accurate, current and complies with the relevant legislation and regulations, however no warranty, representation or guarantee is made, whether express or implied, that the content on the Website is accurate, complete or up to date.

  1. YOUR OBLIGATIONS

8.1 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. Options UK will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.

8.2 You are responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and Conditions and that they comply with them.

You agree to indemnify and hold Options UK and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Options UK arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

  1. SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and you hereby submit to the exclusive jurisdiction of the courts of England and Wales.
